Terms of service

1. The service

Giveaways is operated by Kemma Technologies in Accra, Ghana. We provide tools for hosts to publish promotion details, verify supported entry conditions, freeze entrant lists, and select potential winners using a public, reproducible process.

A host is the sponsor of their promotion unless their official rules name another sponsor. Giveaways does not own, inspect, hold, or guarantee a host's prize.

2. Host responsibilities

A host must:

• provide accurate promotion, prize, eligibility, deadline, and contact information;
• review the generated rules and adapt them to every jurisdiction involved;
• obtain any required permit, registration, bond, approval, tax advice, or professional review;
• comply with X rules and the rules of any other platform they use;
• fund, possess, award, and deliver the stated prize within a reasonable time;
• handle winner communications, taxes, returns, customs, delivery, and disputes; and
• avoid misleading claims, fake engagement, impersonation, or manipulation of entrants.

Our template and technical checks are starting points, not legal advice or confirmation that a promotion is lawful. We may ask for evidence before allowing a promotion to go live and may reject, pause, void, or remove a promotion that creates legal, safety, fraud, platform, or reputational risk.

3. Prohibited prizes and activity

You may not use Giveaways for unlawful goods or services, weapons, controlled drugs, stolen or counterfeit goods, exploitative or sexual services, hate or harassment, malware, financial deception, or anything you cannot lawfully transfer. Alcohol, tobacco, gambling, financial products, medicines, animals, vehicles, property, and other regulated items require our prior written approval and all applicable licences.

You may not interfere with the service, evade rate limits, automate abusive entry, submit false identity information, use multiple accounts to gain extra chances, or try to learn, replace, or influence unrevealed draw material.

4. Entries and potential winners

Entry is subject to the promotion's archived official rules. An entry can be excluded if a recorded condition is not satisfied, the entry was submitted outside the window, the entrant is ineligible, or fraud or abuse is reasonably identified. The first person selected is a potential winner until the host confirms eligibility and the claim.

Provider access can fail or change. Where the published rules allow it, a draw may rely on sealed entry-time verification if a later X recheck is technically unavailable; the verification basis is recorded with the draw evidence.

5. Public record and finality

Publishing locks material promotion and fairness fields. At the deadline, the entrant list is sealed. Draw commitments, entrant-list roots, randomness, results, backups, and audit events may remain public so third parties can verify the result. A promotion may be marked void when a safe or valid draw cannot be completed; a void record is not a promise that the host has no separate obligations to entrants.

6. Fees, accounts, and availability

Paid features, where offered, are charged on the terms shown at checkout. You are responsible for your account and must promptly report unauthorised use. We may change, suspend, or discontinue features, impose reasonable limits, or restrict an account to protect entrants, hosts, the public record, or the service.

7. Disclaimers and liability

The service is provided on an "as available" basis to the extent permitted by law. We do not guarantee uninterrupted provider access, a particular number of entrants, that a host will deliver a prize, or that generated rules satisfy every law. Nothing in these terms excludes liability that cannot legally be excluded. Otherwise, Giveaways and Kemma Technologies are not responsible for indirect or consequential loss arising from a host's promotion, a prize, platform changes, or third-party services.

8. Governing law and contact

These terms are governed by the laws of Ghana, without removing any mandatory consumer protection that applies where you live. Contact us first so we can try to resolve a concern: hello@kemmatechnologies.com.
